Oklahoma

Oklahoma probate creditor notice is unusually specific about both publication and mailed notice: the presentment date must be a date certain at least two months after the notice is filed, and known creditors must get first-class mail notice. Oklahoma also has both a $50,000 small-estate affidavit and a separate summary-administration track for estates of $200,000 or less. Publishing the notice
Publication is required: under 58 O.S. §331 the personal representative gives notice by publishing once a week for two consecutive weeks in a newspaper in the probate county, and the paper must qualify as a county “legal newspaper” under 25 O.S. §106; if more than one qualifies, the filer typically selects one. Creditor claim deadline
On or before the presentment date stated in the notice; that date must be at least 2 months after the notice is filed. ([oklegislature.gov](https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf))

What to do next

  1. Check the filed notice immediately for the presentment date; Oklahoma ties the creditor deadline to that stated date, not just to death. ([oklegislature.gov](https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf))
  2. Document your diligent search for creditors and keep proof of first-class mailing and publication for filing. ([oklegislature.gov](https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf))
  3. If the estate is modest, compare the $50,000 affidavit route with summary administration before opening a full probate. ([oklegislature.gov](https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf?utm_source=openai))
